TERMS OF SERVICE AND CONDITIONS OF USE

Applicability: Domestic (India) Operations Only Effective Date: February 2026

SECTION 1: OVERVIEW AND BINDING AGREEMENT

1.1. Entity Information: This website is operated, under the business name My-HomeLand. Throughout the site, the terms “we”, “us” and “our” refer to MyHomeLand.

1.2. Unconditional Acceptance: By visiting our site or purchasing products from us, you engage in our “Service” and provide affirmative and unconditional consent to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

1.3. Condition of Access: These Terms apply to all users of the site, including without limitation browsers, vendors, customers, merchants, and contributors of content. If you do not agree to all terms, you are prohibited from accessing the platform.

1.4. Right to Amendment: The Company reserves the unilateral right to update, change, or replace any part of these Terms of Service by posting updates to our website without prior notice. Continued use of the platform constitutes acceptance of those changes.

SECTION 2: ONLINE STORE TERMS

2.1. Age of Consent: By agreeing to these Terms, you represent that you are at least 18 years of age (the age of majority as per the Indian Majority Act, 1875). Use of the site by minors is permitted only under the supervision of a legal guardian who agrees to be bound by these Terms.

2.2. Lawful Use: You may not use our products for any illegal or unauthorized purpose nor may you violate any laws in the jurisdiction of India (including but not limited to the Copyright Act, 1957).

2.3. Technological Integrity: You must not transmit any worms, viruses, or any code of a destructive nature. A breach of any Terms will result in an immediate termination of your Services.

SECTION 3: GENERAL CONDITIONS AND DATA SECURITY

3.1. Right to Refusal: We reserve the right to refuse service to anyone for any reason at any time.

3.2. Data Transmission and Encryption: You understand that your content (excluding sensitive financial information) may be transferred unencrypted over various networks and involve changes to conform to technical requirements of connecting networks.

3.2.1. Financial Data Integrity: All sensitive financial information, regardless of the payment method (Prepaid via Razorpay, UPI, Net Banking, or COD verification via GoKwik), is transmitted via SSL/TLS (HTTPS) 128-bit encryption.

3.2.2. Third-Party Processing: We do not store your credit card, debit card, or bank credentials on our local servers. All payment data is processed by PCI-DSS Level 1 certified partners as detailed in our Privacy Policy.

SECTION 4: MODIFICATIONS TO PRICES AND SERVICES

4.1. Price Volatility: Prices for our products are subject to change without notice.

4.2. Service Discontinuance: We reserve the right at any time to modify or discontinue the Service (or any part thereof) without notice.

4.3. Liability Limitation: We shall not be liable to you or to any third-party for any modification, price change, or suspension of the Service.

SECTION 5: PRODUCTS OR SERVICES (DIGITAL AND PHYSICAL)

5.1. Digital Goods: Immediate consumption items, including but not limited to PDFs and digital downloads, are delivered electronically. Due to the nature of digital delivery, these products are non-returnable and non-refundable once the download link or file has been provided to the User.

5.2. Physical Goods: Tangible products shipped to the User are subject to return or exchange strictly in accordance with the timelines and conditions specified in our Return and Refund Policy.

5.3. Mandatory Unboxing Protocol: In accordance with Section 1 of our Return and Refund Policy, all claims for damaged, defective, or missing physical products are subject to the provision of a mandatory, uncut unboxing video. Failure to provide this evidence will result in the summary rejection of the claim for physical goods.

5.4. Accuracy of Representation: We endeavor to display product colors and images accurately; however, we cannot an exact representation of the physical product.

SECTION 6: ACCURACY OF BILLING AND ACCOUNT INFORMATION

6.1. Order Limitations: We reserve the right to refuse any order. We may, in our sole discretion, limit or cancel quantities purchased per person or per order.

6.2. Reseller Prohibition: We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

6.3. User Warranty: You agree to provide current, complete, and accurate purchase and account information for all transactions.

SECTION 7: THIRD-PARTY LINKS AND TOOLS

7.1. Optional Tools: We may provide access to third-party tools (e.g., Shopify apps) "as is" without any warranties. Your use of these tools is entirely at your own risk.

7.2. External Links: Third-party links on this site may direct you to websites not affiliated with us. We are not responsible for examining the content or accuracy of third-party materials.

SECTION 8: USER COMMENTS AND FEEDBACK

8.1. Usage Rights: If you send submissions (comments, suggestions, ideas), you agree that we may, at any time, without restriction, edit, copy, publish, and distribute them.

8.2. Prohibited Content: You are solely responsible for ensuring your comments do not violate any third-party rights or contain unlawful, abusive, or obscene material.

10.2. Limitation of Damages: In no case shall My-HomeLand, its owner(s), or our affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind arising from your use of the Service or any products procured.

SECTION 11: INDEMNIFICATION AND SEVERABILITY

11.1. Indemnity: You agree to indemnify and hold My-HomeLand harmless from any claim, including reasonable attorneys’ fees, arising out of your breach of these Terms or your violation of any law.

11.2. Severability: If any provision of these Terms is determined to be unlawful or void, such provision shall be severed, and the remaining provisions shall remain valid and enforceable.

SECTION 12: GOVERNING LAW AND JURISDICTION

12.1. These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the Republic of India.

12.2. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
